Kansas

Herb Holmberg, Amusement Ride Coordinator
Kansas Department of Labor
417 SW Jackson St
Topeka, KS 66603-3327
(785) 296-4386 Ext. 2308

The Kansas Amusement Ride Act is identified in the

following documents. Reference K.S.A. 2011

Supp 44-1601 thru 44-1614 and K.A.R. 49-55-1

thru 49-55-12. The Kansas law only covers hard

rides, both fixed on site, or those is use by traveling

shows. The law provides nothing for inflatable’s of

any description. The law does cover bungees as well.

The law does require owners to complete and

submit an itinerary report 30 days prior to the

start date for traveling shows. For amusement

park sites at fixed location the same report of

itinerary form must be reported to us annually

notifying us of what rides are in operation at those

sites, further, at fixed sites if or when rides are

put in or removed from service the law requires

notification in either event to our office within

30 days as well. Itineraries can be found,

completed and submitted from our web site.

There are no fees or inspection permits or

stickers issued on any of the rides reported

to us and the state does not do hands on

inspections of rides. However, the Kansas

law does require the amusement ride

coordinator to visit an unspecified number

of sites where amusement rides can be

found in operation, be they fixed, or as

part of a traveling show each quarter of

the year. The Kansas law requires the

inspector to review manufacturer’s manuals,

and the company’s inspection records.

There is a requirement for rides used

in traveling shows to be inspected by

NAARSO Level #1 inspectors every

30 days. At fixed ride locations a

NAARSO Level #1 inspector must annually

make inspection to those rides. Most

recent inspection stickers and notices/warnings

pertinent to each ride are to be prominently

displayed on each ride. The most recent

results of such inspections need to be

visible to people boarding such rides.

The Kansas law is silent about any reporting

requirements following ride accidents. Also,

there is no provision in the law for post accident

investigation involving amusement rides by

the state of Kansas. There is a requirement

for insurance to cover rides though that is

found elsewhere and not addressed in the

Kansas Amusement Ride Act itself.

Also found within the law are requirements for Non Destructive Testing (NDT) for both fixed and mobile rides.
